Civil Liability for Unlawful Federal Targeting of Public Servants

(This action is part of the Catalog of Legislative Actions.)

Description

Holds federal agents personally liable for damages if they unlawfully target public servants for carrying out the provisions of the Restoration of Constitutional Governance and Protection of the People Act. Declares that enforcement actions taken against public servants for following laws enacted under this Act are not legally authorized and are instead personal acts subject to liability under state law.

Affected individuals may bring civil suits in state courts under existing legal standards, including claims for harassment, wrongful prosecution, false imprisonment, and other civil harms. Federal agents are stripped of immunity for these actions, as they are not legally protected acts of government. The statute of limitations for any cause of action brought under this Act shall be the same as for comparable civil claims and shall be tolled during any period when federal interference prevents enforcement.

This provision is enacted as part of the Restoration of Constitutional Governance and Protection of the People Act, either initially or by amendment, and the general provisions of the Act apply to it, including as to jurisdiction and time bar.
