(This action is part of the Catalog of Legislative Actions.)
Holds federal agents personally liable for damages if they unlawfully retaliate against individuals, organizations, or businesses for publicly opposing unlawful federal actions. Declares that enforcement actions targeting truth tellers for political reasons or legal advocacy are not legally authorized and are instead personal acts subject to liability under state law.
Affected individuals may bring civil suits in state courts under existing legal standards, including claims for harassment, wrongful prosecution, selective enforcement, regulatory abuse, and financial coercion. State courts may issue injunctions against ongoing federal retaliation. Federal agents are stripped of immunity for these actions, as they are not legally protected acts of government.
This provision is enacted as part of the Restoration of Constitutional Governance and Protection of the People Act, either initially or by amendment, and the general provisions of the Act apply to it, including as to jurisdiction and time bar.
